Nikki is an intermediate solicitor, specialising in employment law. Nikki has experience representing employers at mediation and as junior counsel in the Employment Relations Authority, Employment Court and District Court. She advises on all areas of employment law, including dismissal and performance management, redundancy processes, restraints of trade, privacy and corporate restructurings. She is also involved in advising and representing employers on all aspects of health and safety in the workplace, including Department of Labour prosecutions.
Liz is an intermediate level litigator, specialising in employment law. She has experience representing several employers at mediation and in the Employment Relations Authority, and as junior counsel in the Employment Court. She provides advice regarding a wide range of HR issues including personal grievances, restraints of trade, employee investigations, redundancy and performance issues, and negotiated exits. She is also involved in advising corporate clients regarding employment issues arising from corporate restructurings.

Avoiding Discrimination

The Human Rights Act and the Employment Relations Act prohibit discrimination on a number of grounds, including sex, marital status, religious belief, colour, race, ethnic or national origins, disability, age, political opinion, employment status, family status, sexual orientation and union membership.
This webinar will look at the main types of discrimination and examine practical ways of avoiding falling foul of the law, including during recruitment, promotion interviews, redundancies and disciplinary investigations.

For the past 3 years she has worked with Elephant Training and HR, and heads up Elephant’s Business Services division, as well as providing HR and Continuous Improvement (CI) advice and support to clients, project managing a range of initiatives and facilitating training on CI, management and HR topics. While working at BNZ she was introduced to Kaizen and moved into a CI role within the HR team. In this role she found she had a real passion for CI and working to make it part of the culture – the way we do things around here. Lisa has a BA in psychology and a Post Graduate Diploma in HR. Her approach is practical and she is passionate about learning and working with managers and individuals to develop their skills and improve how they work.

"Could" a Reasonable Employer Dismiss?

"Could" a fair and reasonable employer dismiss?
This webinar will consider the implications and application of the "could" test for justifying dismissal (and other actions by an employer), which was introduced in April 2011. The session will include an overview of the Angus/McKean v Ports of Auckland cases, as well as an analysis of some recent ERA cases determining what was, and was not, considered to be a justified action on the part of the employer.

Kim has been studying and working with natural healing since 1989 when she was first diagnosed with clinical depression. Several years later this progressed into chronic fatigue and she was forced to leave work. This started the journey to discover the root causes of these and many other health conditions she was experiencing. Since then she has tried over 150 different therapies and trained in several to professional level.
The Art of Health was founded in 2009 as a progression from Kim's previous health businesses, including the Chi Nei Tsang Clinic and Healing Grace Natural Therapies.
